NTEU takes action to secure members' backpay

Evidence has recently emerged of underpayment of casual/sessional academic staff at ACU. NTEU is actively working to ensure that all academic casuals/sessionals receive appropriate remuneration for their work.


Don’t get underpaid: know your entitlements

Casual/Sessional academic staff are entitled to separate payment for marking, if the marking is not 'reasonably contemporaneous' with the delivery of the tutorial or lecture for which the member is being paid.

This means casual/sessional academic staff are entitled to be paid if the marking does not arise directly out of the tutorial or lecture they have delivered, and in any event they are entitled to be paid if the marking is performed more than 7 days after the tutorial or lecture is actually delivered.

In addition to marking, Casual/Sessional academic staff are entitled to separate payment for all work which does not fall within the ‘built up’ rate. That rate only covers preparation for delivery, the delivery itself, and directly associated consultation and marking (as per above.) Other work such as online development, moderation, attendance at meetings, etc must all be paid for in addition to the delivery payments. All these payments must also be made within a fortnight of the work.

Payment for Work Performed is the First Step in Providing a Living Wage

In Pope Leo XIII’s document, On the Condition of the Working Class, written 117 years ago, he denied that employers need only pay a subsistence wage. He insisted that there were objective criteria governing the wage contract and that the wage had to be sufficient to support workers and their families in modest comfort, allowing them to save against sickness and old age, and provide economic security.

Pope John Paul II added that the justice of an entire economy could be judged by how fair their wages were.

Collective Bargaining

Payment for all work done, including separate payment for all marking, is a key claim in the soon to commence Collective Agreement negotiations between NTEU and ACU management.

NTEU will also be seeking more secure employment for fixed term and sessional staff. Over the past ten years fixed term employment has grown from 9.5% of FTE (full-time equivalent) to 22.4% of FTE and casual/sessional employment has grown from 14.4% FTE to 24.4% of FTE at ACU. Previously less than a quarter of the ACU FTE workforce, non-secure employment now makes up almost half of all FTE!
